Terms of Sale

All sales of PlantScan products are made on the following terms and conditions. The item or items being sold by PlantScan are referred to below as “goods” or “products” PlantScan is referred as the “Seller” and the customer is referred to as the “Buyer”
 
1. Agreement. If Buyer has not otherwise agreed to these terms of sale, Buyer’s acceptance of delivery or payment for the goods will constitute Buyer’s agreement to these terms.
 
2. Delivery and Risk of Loss. Delivery will be F.O.B. Lone Tree; Colorado, USA and risk of loss will pass to Buyer upon delivery to the shipper. Shipping dates are estimates only. Time is not of the essence. Seller may ship all the goods at one time or in portions from time to time. Seller will have the right to determine the method of shipment and routing of the goods unless otherwise specified by Buyer.
 
3. Prices shown on the web store are only valid in the USA.  For other countries please contact a regional office, a local distributor or the headquarters in Colorado.  We are in Mountain Time (UTC-7).
 
4. Taxes, Brokerage Fees, Duties. Seller’s price does not include any privilege, occupation, personal property, value added, sales, excise, use or other taxes, brokerage fees or duties and buyer will be liable for any and all taxes, brokerage fees or duties, whether or not invoiced by seller. 
 
5. Unavoidable Delay. If Seller is unable to finish and ship the goods to buyer on time because of anything Seller cannot control (such as casualty, labor disputes, accidents or unavailability of supplies or transportation), the estimated delivery time will be extended accordingly, and Seller will not be liable to Buyer for any damages caused by the delay. 
 
7. Returns. There is a 15% restocking fee for any product that is returned to PlantScan in reusable condition. If the product is not in a reusable condition, in addition to a restocking fee, and a repair charge will apply. Special order or modified items may be returned only at the sole discretion of Seller who is permitted a reasonable time to inspect such items to determine whether it will accept the attempted return. Any returned special order or modified items accepted by Seller will be subject to a restocking charge higher than fifteen percent (15%) that may be determined from time to time by Seller. All returns must be made with the shipping charges prepaid in full and with reference to Seller’s RMA number and invoice number.

6. Credit Cards. PlantScan can only accept credit cards issued by US banks. Because of increased credit card fraud, PlantScan will only ship to the billing address of that credit card.
